SUBLETTING
Subletting is an agreement where a tenant rents out all or part of the property to another person.
Subletting the entire property is only allowed if explicitly permitted in the main rental contract. Partial subletting (e.g. renting out a room) is generally allowed, provided the landlord is informed and gives consent where required.
Partial subletting is quite common among university students.
In this case, one student remains the main tenant, while the others sign a sublease agreement. For landlords, this can be beneficial as it ensures a single point of contact responsible for the property and rent payments.
Please note: agreed rent contracts (canone concordato) usually do not allow subletting, unless it is explicitly permitted in writing.
In all cases, the landlord must be formally informed of the subletting arrangement. This is usually done through a written notice, typically sent by registered mail, including the details of the new tenant, the duration of the sublet, and the part of the property being sublet. If subletting is not permitted under the terms of the main contract, the landlord’s written consent is required. Subletting without authorization may result in the termination of the lease.
The sublease is strictly linked to the main contract, meaning that if the main lease ends, the sublease will automatically end as well.
Finally, the subletting agreement must be registered with the Italian Revenue Agency within 30 days of signing.
